The DWI law needs to be changed. I totally agree that someone drunk, or even buzzing a little, should not get behind the wheel. However, the uniform .08 BAC level is extremely unfair. A 100 lb female who rarely drinks will almost certainly be drunk w severely hindered coordination if they had a .08 blood-alcohol content.
However, for a 250-300 lb heavy drinker, .08 is nothing. These people are stone sober and their coordination is jus as sharp as when they haven't drank at all. I've blown .35 before (I wasn't driving, my cop friend was letting us play with his breathalyzer), and been coherent. I've also blown .08 and no one could even tell I'd been drinking.
I'm not bragging, quite the opposite, as being able to blow almost 5x the legal limit and still be standing, carrying on conversations is nothing to be proud of. I'm saying the .08 should not be a black & white sobriety level.
DWIs should be given based on ability to pass eye, coordination & motor skill, tests. This would prevent many people from getting BS DWI tickets. It would also do a lot to change public opinion that everyone who gets a DWI is a wreckless, irresponsible drunk.
This will never happen, though, cuz DWI tickets are such a Golden Goose for the state and municipality that write those tickets .
Anyone who looks down on people with DWIs is a judgmental hypocrite. Virtually every person who's ever had even a sip of alcohol has driven afterwards. They might not have been drunk, but you'd be surprised how little it takes to get a .05 (DWAI level). If you say youve never driven after even one drink, what about driving while high? Or while on prescription medication that cautions/prohibits driving? These substances have the same effect on your ability to drive as alcohol.
If you still claim to be a totally sober, law-abiding angel behind the wheel, you'd best hold off on judging us, cuz even if youve never driven after taking a mind-altering substance doesnt mean youre any less dangerous on the road. Every year, thousands of fatal accidents are caused by distracted drivers doing other, sober but jus as dangerous things behind the wheel. Talking/texting or even looking at your phone while driving are illegal, and have proven to be very dangerous activities while driving, but i bet at least 80% of people still do it.
Even supposedly innocent things, like changing the music, looking at your GPS, searching your center console for change, holding a simple conversation with your passenger..or anything that involves you taking your eyes off the road, are all risky behaviors and result in just as many accidents as 'drunk' drivers...yet people who participate in these activities aren't ostracized by society like drunk drivers. Why, you ask?... Because alcohol is a convenient scapegoat. It's hard for the government and media to demonize spare change, getting lost or liking music.
